Who is responsible for your data
The controller of your personal data is Maciej Tytus Duchnowski, trading as 313.team Maciej Tytus Duchnowski, ul. Piłsudskiego 33B, 05-077 Warszawa, Poland, Polish tax identification number (NIP): 9522212823.
For matters concerning your personal data, contact us at contact@313.team or at the business address above.
02
The data we process
When you use the contact form, we receive your name, email address, optional brand or company name and message. If you email us directly, we also process the personal data included in that correspondence.
Providing data is voluntary and is not a statutory requirement. Your email address and the content of your enquiry are necessary for us to reply. The form also requires your name. You do not need to provide a company name or information unrelated to your enquiry.
When you visit the website, the website and hosting provider process technical data needed to deliver and protect the service, such as your IP address, request time, requested page and browser information. Technical data may also be associated with a form submission to prevent spam and abuse.
03
Why we process data and our legal bases
- Replying to messages and handling correspondence. We rely on our legitimate interest in communicating with people interested in our business, including people representing companies, under Article 6(1)(f) GDPR.
- Preparing a proposal at your request before entering into a contract with you. We rely on taking steps at your request before entering into a contract, under Article 6(1)(b) GDPR. If you are acting on behalf of another entity, we rely on the legitimate interest described above to process your contact details.
- Operating and protecting the website and form. We rely on our legitimate interest in keeping the service working, diagnosing errors and preventing spam, under Article 6(1)(f) GDPR.
Sending an enquiry does not subscribe you to a newsletter or give consent to receive unrelated marketing messages.
04
How long we keep data
We keep enquiries and the data provided in connection with them for one year from receipt of the enquiry. This applies to submissions stored in Netlify Forms and correspondence in our email account. We then delete them unless there is a separate legal basis for retaining specific data.
If we start working together, we process the data needed to perform the contract and maintain required records for those separate purposes, during the contract and for periods required by law. This does not automatically extend the retention period for all enquiries.
Technical logs are retained for as long as needed to operate and secure the service. This takes account of the hosting provider’s retention periods and the need to investigate a specific error or incident. We do not use these logs to build advertising profiles.
05
Our service providers
Our providers and their authorised subprocessors may access data to the extent needed to deliver their services:
- Netlify, Inc. Provides hosting, form processing and submission storage, as well as security measures.
- Google, the provider of Google Workspace. Provides email services and correspondence storage.
- Squarespace. Acts as an intermediary in the provision of Google Workspace, to the extent required by that role. Google is the technical provider of email.
Providers processing personal data on our behalf operate under data processing agreements. We may also disclose data to competent authorities where required by law.
06
Processing outside Europe
Netlify and Google use international infrastructure. Your data may therefore be processed outside the European Economic Area, including in the United States.
Netlify’s terms provide for transfers under the Data Privacy Framework between the European Union and the United States where applicable, with standard contractual clauses as a fallback in the circumstances set out in its agreement. Google’s terms provide for an appropriate transfer mechanism recognised under European data protection law or the European Commission’s standard contractual clauses.
Details are available in the Netlify data processing agreement and the Google data processing terms. You can also email contact@313.team for information about the applicable safeguards and how to obtain a copy.
07
Your rights
Subject to the conditions in the GDPR, you may request access to your personal data and a copy, rectification, erasure or restriction of processing.
You may object to processing based on our legitimate interests on grounds relating to your particular situation.
The right to data portability applies where processing is automated and based on a contract or consent. We do not base ordinary enquiry handling on a mandatory consent checkbox.
To exercise your rights, email contact@313.team. You may also lodge a complaint with the President of the Personal Data Protection Office in Poland (UODO). Information about submitting a complaint is available on the UODO website.
09
Automation and AI
In connection with this website, we do not make decisions about you based solely on automated processing, including profiling, that produce legal effects or similarly significantly affect you. The website has no AI chat. The form is used to contact our team.
10
